Review of Belarus’ antimonopoly legislation presented in Geneva

MINSK, 16 December (BelTA) - The review of the antimonopoly legislation of the Republic of Belarus conducted by the UNCTAD Secretariat was presented online on 14 December 2020, BelTA learned from Belarus’ Permanent Mission to the United Nations Office and Other International Organizations in Geneva.

“The presentation organized with the assistance of the Permanent Mission of Belarus in Geneva was attended by UNCTAD Secretary General Mukhisa Kituyi, Belarus’ Minister of Antimonopoly Regulation and Trade Vladimir Koltovich, heads and employees of the antimonopoly departments of the EAEU member states, and representatives of international organizations,” the mission informed.

During the opening statement, the UNCTAD secretary general thanked Belarus for its interest and confidence in UNCTAD's expertise in competition law and policy and noted Belarus’ significant contribution to the discussion on ways to promote international cooperation in the enforcement of competition law at the UNCTAD platform.

For his part, Vladimir Koltovich thanked UNCTAD for the work done and emphasized that Belarus regards the topic of competition as one of the key areas in the work of UNCTAD after the UNCTAD-15 Conference. He noted that the recommendations of UNCTAD experts would be taken into account as the country prepares amendments to the competition legislation.

As part of the review, UNCTAD experts analyzed the current antimonopoly legislation of Belarus (in force since August 2018) for its compliance with the UNCTAD Model Law on Competition, international best practices in the field of competition law and policy.

The review focuses on recommendations to improve the Belarusian antimonopoly legislation in terms of its extraterritorial application, approaches to determining the dominant position in connection with the development of the digital economy, regulating the behavior of dominant subjects, prohibiting agreements to restrict competition between economic entities and ensuring non-discriminatory access to goods.
